In order to inform you of its policies and activities with respect to the collection, use and transfer of Personal Data on its websites, Open Cascade is providing you with this Privacy Policy (the “Policy”). This Policy applies to occt3d.com.

Capgemini Engineering Research and Development S.A.S., whose registered office is at 145-151 quai du Président Roosevelt, 92130 Issy-les-Moulineaux, France, is the data controller with respect to Personal Data collected and processed in connection with this website. The website is operated under the Open Cascade and OCCT3D names.

In this Policy, “Personal Data” means information which relates to an individual and which identifies that individual, either directly or indirectly, together with other information that is reasonably likely to come into Open Cascade’s possession, such as your name, email address or telephone number.

Questions concerning this Policy may be submitted through the Contact Us form. Data protection questions and requests to exercise rights over Personal Data may be submitted through the dedicated Open Cascade Data Subject Right Request form.

Processing your Personal Data

Generally, you can visit this website without providing any Personal Data about yourself. However, in connection with a specific purpose, such as communicating with Open Cascade or requesting access to a protected download, we may need to receive Personal Data from you. Providing Personal Data in these cases is voluntary. If you do not provide the requested information, the relevant communication or service may not be available.

Communicating with you. We will keep track of comments and other requests that you submit to us, such as online queries and business-related inquiries. This may include using your Personal Data to communicate with you by email or telephone.

Contact enquiries. The Contact page prepares an email in your own email application. The website does not transmit or store the values entered on that page. If you decide to send the email, Open Cascade will receive the name, sending email address and message that you provide, together with any company name, product, version or technical context that you choose to include. This Personal Data will be used to manage your request, query or inquiry. This processing is based on our legitimate interest to develop and maintain a professional relationship with you or, where applicable, to take steps at your request before entering into a contract.

Protected downloads. The customer download page does not require a website account. If you request access or a package password through the Contact Us form, the Personal Data contained in the email that you choose to send will be used to evaluate and manage your request.

Technical information. The hosting and security infrastructure may process information ordinarily transmitted when a website is requested, including an IP address, date and time of access, requested URL, browser and device information, response status and information necessary to maintain the availability and security of the website.

Website preferences and application data. Some website functions may store preferences or working data on your device. Developer archives. The forum and public issue archives are read-only. They do not provide account registration or accept new posts. The material comes from earlier public Open Cascade community services and has been de-identified for publication on this website. A request concerning Personal Data in an archived record should be submitted through the dedicated Data Subject Right Request form.

Direct marketing and promotion. Personal Data provided for an enquiry is not used to send marketing communications unless a separate service provides an appropriate notice and you make the required choice. This website does not provide a marketing subscription form.

Maintaining the website. Technical information may be used to maintain and improve the website, diagnose faults, protect the website and its users, prevent abuse, and establish, exercise or defend legal claims.

By providing Personal Data, you confirm that you have the necessary authorisation to disclose that information to Open Cascade and for it to be used as described in this Policy.

When you are an existing client, we will keep your Personal Data as long as our contractual and/or business relationship lasts. We may then place your Personal Data in an intermediary archive for five years after the end of that relationship.

If you are a prospect with no established contractual and/or business relationship, we will not keep your Personal Data for longer than three years after you last contacted us.

If you are a recruitment candidate using a separate Open Cascade or Capgemini recruitment service, please consult the notice provided by that service. Information supplied by an unsuccessful candidate is retained for no longer than two years unless that service provides a different applicable period.

Log information collected for security, maintenance and improvement purposes will not be kept longer than one year after collection. Personal Data may be retained longer when required by law or where necessary to establish, exercise or defend legal claims.

Legal bases

Enquiries and requests are processed where necessary to take steps at your request before entering into a contract or on the basis of our legitimate interest in responding to you and maintaining a professional relationship.

Website delivery, security, maintenance and the preservation of useful public technical records are based on our legitimate interests in providing and protecting the website and making technical information available. Personal Data may also be processed where necessary to comply with a legal obligation or to establish, exercise or defend legal claims.

This website does not use Personal Data to make solely automated decisions that produce legal or similarly significant effects for visitors.

Sharing of your Personal Data

Recipients at Open Cascade. In general, your Personal Data can only be accessed by authorised personnel who strictly need to access it. Depending on the purpose of your request, this may include a Project Owner, Technical Manager or Support Contract Manager, as well as authorised personnel responsible for website operation, security, legal matters or data protection.

Service providers. Personal Data may be accessible to service providers acting on behalf of Open Cascade where this is necessary to provide, maintain or secure the website or the relevant communication service. Such access is limited to the purpose for which the provider is engaged and is subject to applicable contractual and legal safeguards, including safeguards for international transfers where required.

Other entities of the Group. Open Cascade is part of Capgemini, which is a global organisation. Its internal processes and infrastructure are international in scope and may cross national borders. Personal Data may be transferred to other Capgemini entities outside the European Economic Area. These transfers are covered by Capgemini’s applicable Binding Corporate Rules.

Governmental, public and judicial authorities. We may be required by laws, court decisions and/or requests from public and governmental authorities within or outside your country of residence to disclose Personal Data. We may also disclose Personal Data where we determine in good faith that disclosure is reasonably necessary for national security, public importance or law enforcement, to protect our rights using available legal remedies, to apply our terms and conditions, to investigate fraud, or to protect our business or users.

Restructuring of activities

Like many organisations, Open Cascade can restructure its operations, including by buying new businesses or by selling or merging existing businesses. These measures may lead us to disclose Personal Data to potential or existing purchasers or to receive Personal Data from potential sellers. Open Cascade provides a dedicated Data Subject Right Request form. Please use that form so that your request can be directed and your identity verified appropriately. Open Cascade may request information necessary to confirm your identity and protect Personal Data from unauthorised disclosure.

Children’s Personal Information

We do not knowingly collect Personal Data from children under 16 without prior verifiable parental consent. If we learn that a child under the age of 16 has submitted Personal Data without parental consent, we will take reasonable measures to delete that information and not use it, except where necessary to protect the safety of the child or others. If you believe that a child has provided Personal Data without verification of parental consent, please submit a request through the dedicated Data Subject Right Request form.

Open Cascade has implemented appropriate technical and organisational measures to ensure an adequate level of security regarding the risk incurred and to protect Personal Data against unauthorised access, disclosure, alteration or destruction.

However, you should be aware that, due to the open and insecure character of the Internet, the security of Personal Data transmitted over the Internet cannot be guaranteed. Where confidential information is required, use a secure delivery method agreed with Open Cascade.
